By using Nano Banana you agree to these terms. Written in plain English, no unnecessary legalese.
What the service is
Nano Banana is a web service that lets you generate images through the Google Gemini 2.5 API. We operate the service, pay Google for the API, and deliver the result to you.
Account and payment
- Free generation (1 lifetime) requires no account.
- Paid plans (Pro, Nano Banana 2) require email and recurring monthly subscription.
- Payments processed by Stripe — we never store your card.
- You can cancel anytime — access stays until the end of the paid cycle.
- Proportional refund within first 14 days (EU consumer right of withdrawal).
What you can do with the images
- Free plan: personal use only. Watermark mandatory. No reselling or commercial product use.
- Pro and Nano Banana 2 plans: full commercial license — use in any legitimate context including resale, advertising, books, merchandise.
- License applies to images generated while the subscription is active. If you cancel, images already generated retain permanent commercial license.
What you may NOT do
- Generate illegal content including non-consensual sexual content, child abuse material, or hate speech.
- Generate deepfakes of real people without their explicit authorization.
- Infringe third-party copyright, trademarks, or personality rights.
- Use the service to deceive (for example, generating images presented as real photographs of events).
- Reverse-engineer, scrape, or automate the service to obtain more generations than your plan allows.
- Create multiple accounts to bypass free-tier limits.
Violations may result in account suspension without refund.
Content responsibility
You are responsible for what you generate. We disclaim liability for damages arising from use of images you requested. The Gemini model has safety filters but isn't perfect — inappropriate content may slip through. If that happens, delete it and report to us.
Service availability
We make every effort to keep the service available 24/7 but do not guarantee 100% uptime. Google Gemini API failures are outside our control. If there's a prolonged outage (more than 48 hours), we proportionally extend the subscription cycle.
Intellectual property
The Nano Banana software, design, and brand are ours. Images you generate belong to you (per plan above). We claim no rights to your generated content.
Dispute resolution
Governing law: Portuguese law. Competent court: Lisbon district. Before going to court, try to resolve by email — we reply to all requests.
Changes to terms
If we materially change these terms, we email Pro/Nano Banana 2 users 30 days in advance. For free users changes take effect immediately but never retroactively.
